US amends EARs for foreign-owned semiconductor fabrication plants in China

The US has amended its Export Administration Regulations (EAR) to remove 3 companies from its Validated End-User Authorizations List. See our US export control pages for details on export control legislation. The companies manufacture semiconductors at fabrication plants in China. They are:
- Intel Semiconductor (Dalian) Ltd
- Samsung China Semiconductor Co. Ltd
- SK Hynix Semiconductor (China) Ltd.
While they were on the Validated End-User Authorizations List, these companies were allowed to export US-origin goods, software and technology without a license. The US Bureau of Industry and Security (BIS) said the companies were using the Validated End-User Authorizations to export manufacturing equipment to China without a license – press release. Because this gave the companies an advantage over US manufacturers, BIS decided to remove them from the Validated End-User Authorizations List.
The companies must now apply for export licenses within 120 days. In its statement, BIS said it intends to grant export licenses for existing fabrication plants in China but that it will not grant licenses to “expand capacity or upgrade technology” at fabrication plants in China.
